Bikellorca
1.1 Bikellorca endeavors to offer high quality specialist bicycles for hire. In order to maintain reasonable costs, we expect our customers to handle the equipment responsibly.
1.2 Before renting bicycles and equipment from Bikellorca, customers must complete a rental agreement form at our offices or confirm the reservation form on our websites, thereby accepting our general terms and conditions. Bikellorca reserves the right to hold the customer’s credit card details as security until the bike is returned in its original condition. By accepting these terms and conditions, a binding contract is concluded between Bikellorca and the renter.
1.3 All bookings are subject to availability. Bikellorca reserves the right to refuse or cancel a booking in the event of bike unavailability or force majeure.
1.4 If a booking is made on behalf of another person or group, the person making the booking confirms to Bikellorca that they have the authority to do so and accepts responsibility for returning the bike in good condition.
1.5 The rental period begins when the bicycle and equipment are collected or dispatched and ends when they are returned to Bikellorca’s premises. The handover protocol shall be signed when the bicycle is collected.
2.1 It is your responsibility to ensure that you are physically fit enough to ride any route or use the equipment you have booked. Bikellorca is not liable for failure to complete the rental period due to lack of fitness, illness or injury. Bikellorca is not liable for personal injury, loss, damage to personal belongings or delays or changes to the rental period due to weather, strikes, war, terrorism or other causes.
2.2 All bikes are carefully maintained by professional mechanics and whilst normal wear and tear during the rental period is acceptable, a charge of €20 will be made if the bike requires excessive cleaning.
2.3 It is the customer’s responsibility to check the condition of the bike thoroughly prior to rental. By renting the bike, the customer acknowledges the condition and state of the bike. Bikellorca encourages customers to ask questions and seek clarification on the condition or operation of the bike if necessary.
2.4 By renting, you acknowledge and accept the inherent risks of cycling on public roads and participating in competitive cycling. You understand and agree that the wearing of a bicycle helmet is mandatory at all times in Spain.
2.5 You must ride the bicycle responsibly and in accordance with the applicable laws. Bikellorca cannot be held responsible for any loss, damage, injury or death to persons or property arising from the use of the rented bicycle and equipment. You accept the responsibility to indemnify Bikellorca against all claims, interests, demands or expenses in connection with such injury or damage.
2.6 You must maintain appropriate insurance throughout the rental period. Bikellorca may offer insurance through reputable and associated insurance providers as part of its services.
2.7 You are responsible for the safety of all rented or borrowed bicycles and equipment. It is your responsibility to prevent damage, loss or theft, to use the items appropriately and to avoid any misuse or excessive wear and tear.
2.8 Any damage caused by accident or negligence will be charged to the customer.
2.9 You must inform Bikellorca immediately of any loss, damage or theft of the rented bikes or equipment, regardless of the cause. You are responsible for paying the reasonable cost of repair or replacement to Bikellorca for any such loss, damage or theft.
2.10 You may only ride on paved roads that are suitable for cycling. It is forbidden to cycle on beaches or unpaved roads.
2.11 You may not sell, dispose of, pawn, lend, pledge or transfer ownership of the rented bike or equipment.
2.12 Bikellorca staff can generally be contacted by telephone or e-mail during the rental period. However, it is the customer’s responsibility to assemble, set up and regularly check the rented bike. Although Bikellorca endeavors to have staff available during the rental period, this cannot be guaranteed.
3.1 Payment is made at the time of booking the bike. Our cancellation policy is as follows:
3.2 In order to arrange and fulfill your rental in accordance with these terms and conditions, you must pay Bikellorca the total price for the rental period and a deposit as stated in the rental agreement form before the start of the rental.
3.3 Late return of the bike will incur a charge of double the published daily rental rate for each day or part of a day that the bike is returned late.
3.4 A credit card is required at the start of the rental period. Depending on Bikellorca’s risk assessment and the value of the equipment, this may include a deposit equal to the value of the bike by credit or debit card payment or other sufficient security. If a deposit is charged, it will be refunded at the end of the rental period, provided that the bikes and/or equipment are returned undamaged to Bikellorca within the agreed rental period and at the agreed place and time.
3.5 Failure to comply with the conditions set out in point 3.4 shall entitle Bikellorca to charge reasonable fees until the bicycles and/or equipment are returned. If the bikes and/or equipment are damaged or left behind, you will be responsible for the cost of repair or replacement (whichever is cheaper) to return them to their pre-rental condition.
3.6 Normal wear and tear, as defined by the manufacturer or supplier of the product, is accepted and included in the rental price.
3.7 The security/damage deposit may be used to cover any costs or charges referred to in this Agreement.
4.1 Cyclists are responsible for their own safety whilst cycling. Cycling involves personal risk and you must ride responsibly.
4.2 Injuries or fatalities related to cycling can be caused by weather conditions, excessive speed, collisions with objects or other people, rider inexperience or misuse of equipment.
4.3 First-time or novice riders should use the equipment under the supervision of an experienced rider.
4.4 Driving under the influence of alcohol, strong medication, drugs or fatigue is strictly prohibited.
5.1 Bikellorca is not liable for death, personal injury or direct loss suffered by you.
5.2 Bikellorca is not responsible for any alleged loss or damage resulting from:
5.3 Bikellorca’s total liability to you under this contract is limited to the total cost of your booking.
5.4 In the event of force majeure, Bikellorca shall not be liable if a booking cannot be fulfilled. If Bikellorca is unable to fulfill your booking due to force majeure, our liability to you shall not exceed the agreed cost of the rental. Force majeure/”Acts of God” do not allow cancelations, but rebooking to a later date is possible.
6.1 These terms and conditions constitute the entire agreement between us and supersede all previous agreements or understandings. Any changes to these terms and conditions must be made in writing. All other terms and conditions, whether by statute or otherwise, are excluded to the fullest extent permitted by law.
6.2 All notices required or permitted to be given between us must be in writing.
6.3 No failure or delay in exercising any right under these Terms and Conditions shall be deemed a waiver and no waiver of any breach by either party shall be deemed a waiver of any subsequent breach.
6.4 If any provision of these Terms and Conditions is found by any court or competent authority to be invalid or unenforceable, the validity of the remaining provisions shall not be affected.
6.5 These Terms and Conditions do not confer any benefit on any third party or the right to enforce them.
6.6 By agreeing to these Terms and Conditions, you agree that the courts of Spain shall have jurisdiction over any dispute that may arise between you and us and that Spanish law shall be the applicable law.
